Inventory Update Rule Webinar Invitation

The ACTA Group

Bergeson & Campbell, P.C. (B&C) and the American Chemistry Council are hosting a free webinar on recent proposed changes to the TSCA Inventory Update Reporting (IUR) obligations on September 28, 2010. In addition to providing a comprehensive overview of the proposed changes, this webinar will also focus on past industry efforts in reporting use and exposure information on Form U, Part III in an effort to assist those companies new to such reporting requirements.

Background. On August 13, 2010, EPA issued a proposed rule modifying reporting obligations under the TSCA IUR. One of the major changes proposed by EPA is lowering the reporting threshold for use and exposure information. In the past, only those facilities that manufactured or imported more than 300,000 pounds in one year at a single facility were required to submit use and exposure information. EPA is proposing to reduce that reporting threshold to 25,000 pounds per year, per facility. This new, lower threshold will capture a much larger universe of chemicals. It is likely that many of the chemical manufacturers/importers potentially impacted by this proposed change are unaware that such reporting obligations may be forthcoming and as such, have not established information gathering systems sufficient to address these new obligations.

Inorganic chemical manufacturers and importers may also be interested in attending the webinar, as they will also be obligated to submit use and exposure information in the 2011 IUR reporting cycle.
