Richard E. Engler, Ph.D., Quoted By Bloomberg Environment in “Chemical Rule Deluge May Catch Companies Off Guard”

On November 6, 2018, Bloomberg Environment quoted Richard E. Engler, Ph.D., Director of Chemistry, The Acta Group (Acta^®), regarding new chemical rules.

Before 2016, the EPA took regulatory action on 10-15 percent of new chemicals, clearing the way for 85-90 percent of new compounds to proceed without restrictions, Richard Engler, Bergeson and Campbell PC’s director of chemistry, said.

But since the amendments to the nation’s primary chemicals law passed in June 2016, those proportions have switched, he has said.

If this trend continues, more firms throughout the chemical supply chain—including aerospace, paint, and electronics makers—will face stricter regulatory obligations.

Export notifications are yet another obligation new-use rules trigger, Engler told Bloomberg Environment.

Companies that export—or plan to export—a SNUR-regulated chemical must notify the EPA so the agency can inform the receiving country, the EPA primer says.

The requirement is a one-time notification per SNUR-regulated chemical per country, Engler said.
