The IBA Agricultural Law Section, supported by the ABA Section of Environment Energy and Resources, Committee on Pesticides, Chemical Regulation and Right-to-Know, the Environmental Law Institute and the National Agricultural Law Center, presents “Sustainable Investment in Agriculture,” with a focus on emerging legal issues in the area of sustainable and responsible investment in agriculture. Presenters will discuss emerging tools and legal models for ensuring sustainable investment in agriculture, with a focus on the UNIDROIT initiative; due diligence for proposed investments; financial instruments; and where we go from here. WEBINAR - - Chemical Regulation After the Mid-Terms: What We Can Expect to See in 2019, February 20, 2019

Bergeson & Campbell, P.C. (B&C®) and Bloomberg BNA were pleased to present “Chemical Regulation After the Mid-Terms: What We Can Expect to See in 2019,” the fifth and final webinar in the 2018 Chemical Policy Summit Series. The mid-term elections fundamentally changed the balance of power on Capitol Hill, and the result will have a significant impact on chemical regulation and environmental matters generally.  The Democrats are now firmly in control of the House, and Congressional oversight will be in high gear.  The House is widely expected to launch a dizzying number of investigations, almost certainly some of them related to the U.S. Environmental Protection Agency’s (EPA) positions on climate change, the role of science, ethical lapses, and deregulation in general.  The use of subpoenas is also expected to be in full display this year.  House and Senate leadership in key Committee assignments will change and so also will the personalities, tone, and content of Congressional oversight of and priority setting related to chemical and other environmental matters.  Speakers Alexandra Dapolito Dunn, Assistant Administrator, U.S. Environmental Protection Agency (EPA) Office of Chemical Safety and Pollution Prevention; Beau Greenwood, Executive Vice President, Government Affairs, CropLife America; Lynn L. ELI Summer School Series 2018: Law & Policy of Products Regulation, July 24, 2018, Washington, D.C. and via Webinar

The life cycle of industrial, agricultural, and antimicrobial chemical products, especially those embedded in consumer products, has gained increasing public attention. Regulators are beginning to look at the entire product life cycle, including after the discard of a product at the end of its useful life, not just toxicity data. Lynn L. Bergeson, President, The Acta Group (Acta®), presented Law & Policy of Products Regulation, examining the regulation of chemicals that are used in industrial and consumer products, as well as pesticides, and describing the new governance and stewardship initiatives being considered globally by a wide variety of stakeholders to diminish the potential for adverse effects from chemicals. A complimentary recording of this presentation is available on ELI's website.

Bergeson & Campbell, P.C. (B&C®) and Bloomberg BNA were pleased to present “FIFRA Hot Topics,” the second webinar in the 2018 Chemical Policy Summit Series. This complimentary, hour-long webinar featured Rick P. Keigwin, Jr., Director, Office of Pesticide Programs (OPP), Office of Chemical Safety and Pollution Prevention (OCSPP), U.S. Environmental Protection Agency (EPA), Daniella Taveau, former International Trade Negotiator for EPA and now Regulatory and Global Trade Strategist, King & Spalding, and William L. Jordan, former senior toxics lawyer with EPA’s OPP and Office of General Counsel.  This timely and fascinating conversation was augmented by B&C Senior Government Affairs Consultant, James V. Aidala, and moderated by Lisa M. Campbell, Partner, B&C. 

Topics covered included OPP priorities and current FIFRA implementation issues,  ESA opportunities and challenges, the EPA OPP program budget and industry fee contributions (e.g., the Pesticide Registration Improvement Act (PRIA)), registration review actions on glyphosate, neonicotinoid insecticides, pollinator protection, trade barriers, other globalization challenges, and more.

CPDA 2018 Regulatory Policy Conference provided Council of Producers & Distributors of Agrotechnology (CPDA) members and non-members alike a valuable opportunity to gather to discuss key developments and regulatory challenges, unique to the agrotechnology industry, that must be addressed for companies to stay competitive and operate successfully in the global marketplace. Participants received insights from regulatory agency officials on addressing the requirements specific to manufacturers, formulators, distributors, and suppliers of adjuvants and inert ingredients. Bergeson & Campbell, P.C. presented a complimentary webinar that reviewed EPA's current guidance and recent decisions on spray drift and volatilization issues and discussed what registrants may have to do to navigate the registration review process. Speakers included well recognized experts on these complex issues: Jeff Dawson, Senior Scientist, Chemist at EPA's Health Effects Division, B&C's Senior Scientist Susan H. Youngren, Ph.D., and Senior Government Consultant James V. Aidala, The webinar was moderated by Lisa M. Campbell, Founding Member of B&C. Their presentation was followed by a Q&A with webinar participants.

US/Global Biocides (Antimicrobials) Regulation Conference, September 25-26, 2014, Washington, D.C.

A two-day Conference brought together experts from the USA and Europe to discuss latest developments in the regulation of Biocides. The first day covered new developments in the US, including: “New Data Requirements for Antimicrobials (implementation of 158W),” “Efficacy Testing for Public Health Products,” “Testing – the Rise of Alternative Approaches,” and “Food Contact and Antimicrobials.”

Day two of the conference looked at global developments in the regulation of biocides. Countries and legislation covered included Canada, Europe and the BPR, and Asia. The conference closed with a workshop covering the challenges of working in a global market and will include cross-comparisons between the European Union, the US and China.

Burchi gave a presentation on Sept. 26th on “US Industry View of the BPR from First Years of Implementation” including first experiences with product authorization, clarifying treated articles status, active substance suppliers, data sharing and compensation challenges and comparison to FIFRA, and the status of guidance. EPA's Supplemental Distribution Enforcement Actions Are Buzzing: How to Avoid Getting Stung, July 23, 2014, Washington, D.C.

The U.S. Environmental Protection Agency (EPA) has made good on its intent to focus enforcement efforts on Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) supplemental distribution, resulting in several settlements with significant penalty assessments. B&C recently issued a memorandum discussing the enforcement actions, the regulatory requirements for supplemental distribution, and what issues companies should address to help avoid such an enforcement action. That memorandum is available online.

As a further service to clients and friends, B&C presented a complimentary webinar highlighting the most important steps that both registrants and supplemental distributors could take to ensure compliance and avoid being stung in the current heightened enforcement environment. Speakers included B&C’s Lisa R. Burchi and Sheryl L. Dolan, and attorney Jon Jacobs, a 25-year veteran of EPA’s Office of Enforcement and Compliance Assurance who has recently entered private practice. Their 45–minute presentation wasl followed by Q&A with webinar participants.
