When the Toxic Substances Control Act (TSCA) was enacted in 1976, the U.S. Environmental Protection Agency (EPA) focused its attention on chemical substances and chemical mixtures, while largely exempting the regulation of chemicals in “articles,” generally meaning finished products or manufactured goods. EPA’s more recent announcement of its intent to regulate chemicals in articles to a much greater extent has caught many in the regulated industries off guard and reflects a significant shift in U.S. chemical regulation policy. This change in policy affects all commercial entities that deal with a physical product, as they must now become familiar with the law, its requirements, and the chemical makeup of their finished goods. Join the National Association of Chemical Distributors (NACD) and Bergeson & Campbell, P.C. (B&C®), for a Virtual Toxic Substances Control Act (TSCA) Hot Topics Regulatory Workshop. The workshop was held in two-hour interactive online sessions August 11-13, 2020, and was presented by regulatory experts from B&C, including Managing Partner Lynn L. Bergeson, Director of Chemistry Richard Engler, Ph.D., and Senior Regulatory Consultant Kathleen Roberts. The workshop began with a review of TSCA and covered current hot topics including Significant New Use Rules (SNURs), the high-priority chemical risk evaluations and industry fees, Chemical Data Reporting (CDR), and more. Participants were able to ask questions of the presenters following each topic. At the end of the workshop, participants joined break-out rooms divided by topic to discuss what was learned and share their experiences.

The webinar focused on draft EPA guidance intended to clarify the lines between and among those products that are subject to FIFRA registration as plant regulators and those biostimulant products not subject to FIFRA registration. The webinar also focused on new and evolving chemistry and technology issues that may blur some jurisdictional lines or potentially move products from one category to another.  Lynn L.
