The ACTA Group

Chemical lawyer and Toxic Substances Control Act (TSCA) expert Lynn L. Bergeson was featured Monday, January 13, 2014, on the National Public Radio (NPR) program “All Things Considered.”

In a story on the mysteries that persist around a chemical spill in the Elk River near Charleston, West Virginia, NPR reporter Elizabeth Shogren interviewed Ms. Bergeson, whose comments were included in the national radio broadcast and NPR’s web version of the story: “‘These incidents are very painful for the local residents there in West Virginia, they are embarrassing to federal and state governments that would appear to not have as much information as they would like to be able to report to local residents.’ Bergeson hopes this incident will spark interest in the 40-year-old law that governs toxic chemicals.”

Ms. Bergeson, Managing Partner of Washington, D.C.-based law firm Bergeson & Campbell, P.C. (B&C®), has earned an international reputation for her deep and expansive understanding of TSCA and the policy process surrounding it. She counsels corporations, trade associations, and business consortia on a wide range of issues pertaining to chemical hazard, exposure and risk assessment, risk communication, minimizing legal liability, and evolving regulatory and policy matters pertinent to products of conventional, biotechnology, biobased chemicals, nanotechnologies, and other emerging technologies, particularly with respect to TSCA, Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), Food Quality Protection Act (FQPA), Registration, Evaluation, Authorization and Restriction of Chemicals (REACH), and Occupational Safety and Health Administration (OSHA) matters.

She writes and speaks frequently; recent articles on TSCA and TSCA reform efforts include “Toxic Substances Control Act Reform: The New State of Play,” Environmental Quality Management, Winter 2013, and “Hope Is Restored In Finally Modernizing TSCA,” Law360, June 2013.
